This Privacy Policy explains how Sunkissed Resort Living LLC ("Sunkissed", "we", "us") collects, uses and shares your personal information when you visit getsunkissed.com (the "Site"), buy from us, or sign up for our emails or texts.

What we collect

Information you give us. Your name, email address, phone number, shipping and billing address, order details, the size you tell us you wear, and anything you send us when you contact us. Payment card details are entered into our payment processor's secure checkout; we never see or store your full card number.

Information collected automatically. When you browse the Site we collect device and usage information, such as your browser type, IP address, approximate location, the pages and products you view, and how you arrived at the Site. We collect this with cookies, pixels and similar technologies.

Information from others. If you buy Sunkissed through a retail partner or marketplace, that partner may send us the details we need to fulfill your order. Those purchases are also governed by the partner's own privacy policy.

How we use it

• To process, ship and deliver your orders, and to handle returns and exchanges.
• To answer your questions and provide customer service.
• To send you emails and, if you opt in, text messages about new arrivals, launches and offers. You can unsubscribe at any time.
• To understand how the Site is used, improve it, and show you more relevant products and ads.
• To prevent fraud, keep the Site secure, and meet our legal, tax and accounting obligations.

Who we share it with

We share personal information only with companies that help us run our business, and only for the purposes above:

• Store and payments: Shopify, which hosts our store and processes payments (Shopify's privacy policy).
• Email and SMS: Klaviyo, which sends our emails and text messages.
• Fulfillment, shipping and returns: our warehouse and fulfillment partners, shipping carriers, and returns providers.
• Tax: sales tax calculation and compliance services.
• Analytics and advertising: partners that help us measure the Site and show our ads, including Google and Meta. These partners may collect information through cookies and pixels on the Site.
• Legal reasons: when required by law, to respond to lawful requests, or to protect our rights, customers or others.
• Business transfers: if Sunkissed is involved in a merger, sale or similar transaction, your information may transfer as part of it.

We do not sell your personal information for money. Some of the advertising described above may count as "selling" or "sharing" personal information under certain US state laws. You can opt out as described under Your choices.

Text messages

If you sign up for Sunkissed texts, you agree to receive recurring automated marketing messages at the number you provide. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. We do not share your mobile number or text consent with third parties for their own marketing.

Cookies

We use cookies that are needed for the Site and checkout to work, plus analytics and advertising cookies. You can control cookies through your browser settings and, where offered, our cookie banner. Blocking some cookies may affect how the Site works. We honor Global Privacy Control signals as a request to opt out of the sale or sharing of personal information.

Your choices and rights

• Marketing: use the unsubscribe link in any email, or reply STOP to any text.
• Access, correction and deletion: depending on where you live (including California and other US states, the EU and the UK), you may have the right to know what personal information we hold about you, to correct it, to delete it, to receive a copy, and to opt out of the sale or sharing of your information or targeted advertising.
• To make a request, email info@getsunkissed.com. We will verify your request and respond within the time the law requires. You may use an authorized agent, and we will not treat you differently for exercising your rights.

How long we keep it

We keep personal information for as long as needed to fulfill orders, provide service, and meet our legal, tax and accounting obligations, and then delete or anonymize it.

Security

We use reasonable safeguards to protect your information, but no method of transmission or storage is completely secure.

Children

The Site is not directed to children under 16, and we do not knowingly collect personal information from them. If you believe a child has given us information, contact us and we will delete it.

International visitors

We are based in the United States. If you visit from outside the US, your information will be transferred to and processed in the US and other countries where our service providers operate.

Changes

We may update this policy from time to time. The date at the top shows when it last changed.
